KONSUMENTENKREDIT-RICHTLINIE - Österreichische Präsidentschaft legt vierten Entwurf der Konsumentenkreditlinie vor.
Keine Rückkehr zur Begrenzung der Überschuldung im 2002 Entwurf aber einige Verbesserungen im Detail. Für die Sitzung der Arbeitsgruppe Konsumentenkredit-richtlinie hat die österreichische Präsidentschaft einen leicht überarbeiteten Entwurf vorgelegt. Die Grundprobleme einer reinen Marktliberalisierung ohne Rücksicht auf die nationale Kultur der Überschuldungsprävention bleiben erhalten. Insbesondere findet sich kein Schuldnerschutz in der Regelung.

Die wichtigsten Probleme bleiben: Kredit auf Mausclick, Heimatland des Kreditgebers gibt das Recht, Verbot nationalen Verbraucherschutzes durch Maximalharmonisierung, durchlöcherter Anwendungsbereich (insbesondere Leasing), Einführung kostenpflichtiger Entschuldung.

Es gibt auch einige Verschlechterungen im Detail. Eine wichtige Verbesserung stellt aber die Einbeziehung der Versicherungskosten in den Kredit dar, wenn wie zumeist ein faktischer Zwang besteht.

ARE THE BASIC THREATS FOR NATIONAL CONSUMER PROTECTION OF THE DRAFT REMEDIED? – NO BUT A QUESTION MARK ON MUTUAL RECOGNITION HAS APPEARED

UPHOLD:

• Abolishment of the written form and opening the market for pure Internet Credit (debt on mouseclick) (Art.9 no 1)

• Home country law of the supplier side (mutual recognition) concerning important duties (21 2.) (this in parentheses which may indicate openness for discussion)

• Limitation of national consumer protection through maximum harmonisation principle (26th regime i.e. forbidding Belgian duty to interrogate data bases; German legislation on consuemr credit higher than 100.000 €; German duty to indicate the total amount of all cost instead of only direct credit cost, English, Irish, Belgian, French duties to handwritten commitments for debts and warnings etc; exclusion or limitation to early repayment indemnisations (nearly all states) (21 1. “not other than”) - The new slogan in the motivations "be limited to its scope as determined by these definitions" has no repercussions in the text of the directive

• Exemptions are still far reaching and make this directive inapplicable in a secure and comprehensive way. - i.e. Leasing contracts still are exempted if the creditors designs the form in such a way that no legal obligation for acquiring property is part of the contract. It is now amended for cases where creditors can later on choose such a right (which seems to be self-evident) (2 2.g)

• Free early repayment remains abolished for most credit contracts but

• not applicable to small credit amounts under 3000 € and not if credit insurance pays for the outstanding balance. (15 3.)
• clear definition that outstanding interest and cost concerning the still remaining duration has to be fully refunded but
• early repayment indemnities for fixed rate credit which may be as high as 20% of the outstanding amount in German mortgage loans are payable.

PREVENTION OF OVERINDEBTEDNESS? - NO

• The purpose of the directive nor those regulations of the first draft concerning the prevention of overindebtedness have been reconsidered. (refinancing, guarantors' protection, responsibility for the credit and not only for the use of information, open end credit, endowment credit contracts etc.)

• There is no specific distinction made between an informational approach in consumer protection which can help consumers who have choices and a social approach in consumer protection which tends to protect debtors. These regulations are national but often interlinked with EU-regulations. (see APR definition and usury ceilings)

ARE THERE DETEORIATIONS FOR CONSUMER PROTECTION? SOME

• Social credit is now exempted even if it is at market rates. (2 2.k)

• Art. 5 3. where immediate information is required has been stroked out.

• Overdraft does not have to be adjusted if overrunning persists (17 2.)

ARE THERE ANY CHANGES TO THE BETTER? A FEW ONE IMPORTANT ON CREDIT COST

• Predatory insurance premiums have been tackled and the APR may gain back a bit of its lost significance.

• "total amount payable by the consumer" has now to be disclosed (4 2e; 5 2. bb, 9 cb) This is defined by credit cost (3 fa) but

- Credit cost (3 f) now got a new definition which goes back to the definition in the first draft because all cost have to be inserted and disclosed "if the conclusion of the service contract is - according to the contract or the factual circumstances (!!) - compulsory for obtaining the credit or the advertised interest rate:"

- this acknowledges that there can logically not be any obligation towards a bank in an offer the consumer makes legally to the bank. The practice to let first ask for expensive and exclusive insurance and then for the credit can no longer be circumvented by a simple clause about fictive free decisions.

• There are ameliorations in credit legally "linked" to purchases and services. rights are extended to cases of nullity and lack of supply and vices. (Art. 14)

• The scope of exemptions has been reduced: from 300 to 200 € from 50 to 100.000 €. Only short term credit linked to securities is exempted. (2 4.)

• The amendment questions the exclusion of fees to third persons from the price disclosure by putting it into parenthesis (but does not strike it out) (3f)

• There has now to be a "representative example" (3 ga) including insurance fees.

• To exercise the right of withdrawal does no longer require a prior notice) (13 2.)

• Amortisation Table are extended to variable rate credit (9 g)
